Commercial Contract with Registrant for .gov.uk Domain Names

1. Introduction

1.1 This document outlines the terms and conditions governing the agreement between Whamos Ltd ("the Registrar") and the Registrant ("the Client") for the registration, management, and use of .gov.uk domain names. 1.2 These terms are supplementary to the overarching terms set by Nominet UK and the UK Government Digital Service (GDS) for .gov.uk domains, as detailed in the GOV.UK Additional Terms for Agreements. 1.3 By entering into this agreement, the Registrant agrees to comply with all applicable laws, policies, and requirements associated with .gov.uk domains.

2. Definitions

• 2.1 "Registrar" refers to Whamos Ltd, authorized to manage domain registrations for .gov.uk domains.
• 2.2 "Registrant" refers to the Client applying for or maintaining a .gov.uk domain.
• 2.3 "Nominet" refers to the official registry for .uk domain names.
• 2.4 "GDS" refers to the Government Digital Service, responsible for overseeing .gov.uk domains.

3. Eligibility

3.1 The Registrant must meet the eligibility criteria defined by GDS, including:

• Being a public sector organization in the UK.
• Providing services funded by UK taxpayers.

3.2 Proof of eligibility must be submitted at the time of application.

4. Registrar Responsibilities

• 4.1 The Registrar will:
  • Process applications for .gov.uk domains in line with GDS policies.
  • Maintain accurate and up-to-date records of domain registrations.
  • Provide ongoing support for domain management.
  • Notify the Registrant of any policy changes affecting the domain.
• 4.2 The Registrar reserves the right to reject applications or suspend domains if the Registrant fails to meet eligibility requirements.

5. Registrant Responsibilities

• 5.1 The Registrant must:
  • Provide accurate and complete information during the application process.
  • Ensure continued compliance with GDS and Nominet policies.
  • Promptly notify the Registrar of any changes to their eligibility or contact details.
• 5.2 The Registrant must not:
  • Use the domain for unlawful purposes.
  • Transfer the domain to an ineligible third party.

6. Fees

• 6.1 Registration and renewal fees for .gov.uk domains will be outlined in the Registrar’s pricing schedule.
• 6.2 Fees must be paid in full before registration or renewal is completed.
• 6.3 The Registrar reserves the right to amend fees, providing notice to the Registrant.

7. Term and Termination

• 7.1 This agreement remains in effect for the duration of the domain registration.
• 7.2 The agreement may be terminated if:
  • The Registrant no longer meets eligibility criteria.
  • The Registrant breaches these terms.
  • The domain is no longer required.
• 7.3 Upon termination, the Registrar will notify Nominet and GDS, and the domain will be deactivated.

8. Dispute Resolution

• 8.1 Disputes related to .gov.uk domains will be handled according to Nominet’s dispute resolution service.
• 8.2 The Registrant agrees to cooperate fully in the resolution of disputes.

9. Liability

• 9.1 The Registrar will not be held liable for:
  • Losses resulting from domain suspension or termination due to the Registrant’s non-compliance.
  • Issues arising from Nominet’s or GDS’s policies.
• 9.2 The Registrant agrees to indemnify the Registrar against claims arising from misuse of the domain.

10. Amendments

• 10.1 The Registrar reserves the right to update these terms to comply with changes in Nominet or GDS policies.
• 10.2 The Registrant will be notified of amendments and given a minimum of 30 days’ notice before changes take effect.

11. Governing Law

• 11.1 This agreement is governed by the laws of England and Wales.
• 11.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
